Looking Glass Rental Agreement

THIS EQUIPMENT RENTAL AGREEMENT ("Agreement") is made effective upon the Lessee’s confirmation of a rental order and acknowledgment of these terms, between Looking Glass Photographic Outfitters ("Lessor") and the customer renting equipment ("Lessee"). By checking the box next to “I have read and agreed to the terms,” Lessee confirms agreement to this Rental Agreement and all terms stated herein. No rental may proceed without this affirmative acceptance. This Agreement applies only to the rental transaction in which the Lessee confirms these terms. Lessor may update this Agreement for future rentals.

1. Disclaimer

Lessor strives to provide accurate descriptions and pricing. However, all prices and availability are subject to change without notice. Lessor reserves the right to correct errors or omissions.

2. Rental Terms

Lessor agrees to rent, and Lessee agrees to rent, the equipment listed on the rental confirmation receipt ("Equipment") under the terms of this Agreement. Equipment must be picked up and returned at Lessor's store in Berkeley, CA, unless otherwise arranged. Shipping is not offered. Local delivery/pickup may be arranged under a separate written agreement.

3. Rental Period

The rental period begins when Equipment is picked up and ends when returned by the agreed date and time. Late returns incur fees (see Section 7).

4. Rental Fees

Rental fees and applicable deposits must be paid in full at the time of reservation. Fees are non-refundable, except as outlined in Section 10. Lessee understands and agrees that returning Equipment prior to the scheduled return date does not entitle them to a refund, credit, or price adjustment for any unused rental days.

5. Lessee Responsibilities

Lessee agrees to:

- Provide a valid government-issued photo ID and a major credit card issued by a reputable bank at pickup. For rental security purposes, debit cards, prepaid cards, reloadable cards, and gift cards are not accepted, even when branded with Visa, Mastercard, American Express, or Discover. Copies are kept on file during the rental.

- Use the Equipment in a careful and lawful manner.

- Not modify, repair, or alter the Equipment without written consent.

- Take full responsibility from pickup to return.

6. Authorization for Charges

Lessee authorizes Lessor to charge the credit card on file for damages, late fees, cleaning fees, loss, or other charges specified in this Agreement.

7. Late Returns

Late returns will incur a fee of 150% of the first-day rental rate per overdue day. If not returned within 7 days, the Equipment is considered lost and Lessee will be charged the full replacement cost.

8. Loss or Damage

Lessee assumes full responsibility for Equipment during the rental. Lessee agrees to pay for repair costs (as determined by Lessor or a certified repair facility) or the current market replacement cost in the event of loss or theft.

9. Condition of Equipment

Lessee must inspect the Equipment upon pickup and report any pre-existing issues within 24 hours. Otherwise, the Equipment is deemed accepted in good condition.

10. Cancellations

By Lessor:

- Lessor may cancel any order prior to pickup for any reason.

By Lessee:

- Cancel 72+ hours in advance for full refund.

- Cancel 24–72 hours in advance for 50% refund.

- Cancel within 24 hours of pickup: no refund.

11. Ownership

All Equipment remains the property of Lessor. No transfer of ownership occurs through rental.

12. Cleaning Fees

Cleaning fees may apply if Equipment is returned with dirt, sand, smoke residue, or other substances requiring special cleaning.

13. Indemnification and Liability

To the extent permitted by California law, Lessor is not liable for damages or injuries resulting from Lessee’s use of the Equipment. Lessee agrees to indemnify and hold Lessor harmless from any resulting claims.

14. Default

In case of default, including non-payment or failure to return Equipment, Lessor may pursue legal remedies including collection, legal fees, and recovery of Equipment.

15. Governing Law

This Agreement is governed by California law. Disputes will be resolved in Alameda County, CA.

16. Force Majeure

Neither party shall be liable for delay or failure to perform due to causes beyond their reasonable control, including natural disasters, government action, or other force majeure events.

17. Entire Agreement

This Agreement is the complete understanding between Lessor and Lessee. Any amendments must be made in writing and agreed to by both parties.

By checking the box next to “I have read and agreed to the terms” during the rental checkout process, Lessee acknowledges they have read, understood, and agreed to this Rental Agreement.
